Adverse Possession

If your neighbor uses your land for a period of time without your objecting to his use, that neighbor may be able to claim the land that he has been using. Minnesota Statutes require a minimum of 15 years to establish adverse possession. Certain conditions must be proved to have existed for the entire 15 years before an adverse claim can be awarded by the court. The existence of an unrecorded claim against your property or a claim you may have against your neighbor's property may not show up in a title search and can only be discovered with a property survey.
